1. Who we are and what these terms cover

Belvora ("we", "us", "our") operates this online store and the related content, features, tools, products and services (together, the "Services"). The Services are hosted on Shopify. These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, Promotions & Prize Terms and Claims, Imagery & Disclaimers page (each incorporated by reference), form the agreement between you and us.

Please read them carefully. They contain disclaimers of warranties, limitations of our liability and, for customers in the United States, an agreement to resolve disputes by individual arbitration. By browsing or ordering from the Services you accept these terms. If you do not accept them, please do not use the Services.

Nothing in these terms excludes or limits any right you have under mandatory consumer law in your country. Where a provision conflicts with such a law, that law prevails and the rest of these terms continue to apply.

2. Eligibility and your account

You must be at least the age of majority where you live to buy from us. You agree that the information you give us, including contact, billing, payment and delivery details, is accurate and complete, and that you are authorised to use the payment method you provide. You are responsible for activity that takes place through your account and for keeping your credentials secure.

3. Our products: what we do and do not claim

Belvora sells cosmetic products. Our products are cosmetics, not medicines or medical devices. They are not intended to diagnose, treat, cure or prevent any disease or condition, and nothing on the Services is medical advice.

Cosmetic results are personal. Our lipstick contains a pH-reactive pigment, which means the tint that develops depends on the chemistry of your own lips. Shade, intensity, comfort and how long the colour lasts will differ from person to person and from day to day. Any shade, finish or wear time shown or described anywhere on the Services is an illustration of what is possible, not a promise of the result you personally will get.

Product imagery, including any before-and-after or comparison images, is campaign and illustrative material rather than a record of a measured test. Colours on screen vary with your device. Packaging and formulation may be updated over time. Our Claims, Imagery & Disclaimers page explains this in more detail and forms part of these terms.

Before first use, patch test on a small area. Stop using the product and seek advice if you experience irritation, discomfort or an allergic reaction. Check the ingredient list if you have known sensitivities. Keep out of reach of children. For external use on the lips only.

4. Orders

Your order is an offer to buy. It is accepted only when we confirm it, and we may decline or cancel any order, including where a product is unavailable, where there is an error in the listing or price, or where we suspect fraud or resale. If we cancel an order you have already paid for, we refund you in full.

We aim to describe and price everything accurately, but errors happen. Where an obvious error affects your order we will contact you before dispatch and give you the choice of proceeding at the correct price or cancelling for a full refund. You confirm your purchases are for personal or household use and not for resale.

5. Prices, promotions and reference pricing

Prices are shown in the currency displayed at checkout and may change at any time. The price that applies is the one shown when you place your order and confirmed in your order confirmation. Unless stated otherwise, prices exclude shipping and any customs duties or import taxes.

Where we show a higher struck-through figure next to a multi-item bundle, that figure is the amount the same number of items would cost at our standard single-item price. It is a comparison against our own current single-item price, not a claim that the bundle was previously sold at that amount.

Promotions, discount codes, bundles and prize draws are governed by our Promotions & Prize Terms, which take precedence over this section where they conflict.

6. Shipping, risk and title

Delivery estimates are estimates, not guarantees, and run from dispatch rather than from the moment you order. We are not liable for delays caused by carriers, customs processing, weather or other events outside our reasonable control. Risk in the products passes to you on delivery. 7. Returns and our guarantee

Our 90-day satisfaction guarantee and your statutory cancellation rights are set out in our Refund Policy, which forms part of these terms.

8. Marketing communications

If you give us your email address, including through a sign-up form or on-site promotion, you consent to receive marketing emails from us. You can withdraw that consent at any time using the unsubscribe link in any message or by writing to us. We will still send you transactional messages about orders you have placed.

9. Intellectual property and acceptable use

The Services and their content, including text, images, graphics, video, audio, trade marks and their selection and arrangement, belong to us or our licensors and are protected by intellectual property law. You may use the Services for your own personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, scrape or create derivative works from any part of the Services without our written permission.

You agree not to use the Services unlawfully, to infringe anyone's rights, to upload malicious code, to harvest other people's personal information, to interfere with the security or operation of the Services, or to submit content that is false, misleading, defamatory or offensive. We may suspend or end your access if you do.

10. Third-party services

The Services rely on third parties, including Shopify for hosting and payment processing and carriers for delivery. Links to third-party sites are provided for convenience. We do not control third-party sites and are not responsible for their content, policies or practices.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Services and the products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error free, or that any particular cosmetic result will be achieved. Some jurisdictions do not allow the exclusion of implied warranties, so some or all of this section may not apply to you, and nothing here affects your non-excludable statutory rights.

12. Limitation of liability

To the fullest extent permitted by law, we and our officers, employees, affiliates and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or connected to your use of the Services or the products, whatever the legal basis of the claim.

Where our liability cannot be excluded, our total aggregate liability to you for any claim is limited to the amount you actually paid us for the product giving rise to the claim. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

13. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the Services, or your violation of any law or third-party right.

14. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which Belvora is established, without regard to conflict-of-law rules. Any dispute will be brought in the courts of that jurisdiction, except that if you are a consumer resident in the European Union or the United Kingdom you keep the benefit of the mandatory consumer protection rules of your country of residence and may bring proceedings in your local courts.

Customers in the United States. You and we agree that any dispute that cannot be resolved informally will be settled by binding individual arbitration rather than in court, and that you and we each waive the right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by emailing care@belvora.co within 30 days of your first order, stating your name, order number and that you opt out. Opting out does not affect any other part of these terms. Either of us may still bring an individual claim in small claims court.

Before starting any formal proceedings, please contact us at care@belvora.co so we can try to resolve the matter. Most issues are settled quickly this way.

15. General

If any provision is found unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms without our consent; we may assign ours in connection with a merger, acquisition or sale of assets. We are not liable for failure to perform caused by events beyond our reasonable control. These terms, together with the policies referenced in them, are the entire agreement between us.

16. Changes

We may update these terms by posting a revised version on this page and updating the date above. Changes apply to orders placed after they are posted. Your continued use of the Services means you accept the revised terms.
